Commission agreement breakdown
I MUST be informed before starting a commission if it is for commercial purposes. 
The agreement for if you are going to use the commission for personal use. 
Client: person commissioning the artist 
Clients are responsible for the following: Providing A description of the project itself and/or the client’s vision, Providing Reference photos, providing a Timeline or deadline estimate, Cost of delivery of commission
Official commission communications can be done through social media DMs, and the Work can be delivered through DMs, however for best service communications should be through Email.
Things prohibited unless decided upon in a commercial agreement: DISPLAY/SHARE WORK PUBLICLY AS LONG AS DISPLAYED ALONG WITH LINK TO ARTIST SITE, ARTIST NAME, AND MUST NOTIFY ARTIST. REDISTRIBUTION, REPRODUCTION, EXPORTATION AS AN NFT, OR PROFIT OF ANY FORM UNLESS COMMERCIAL TERMS OF SERVICE IS AGREED UPON. SUBMISSION OF COMMISSION TO ANY KIND OF ONLINE OR OFFLINE CONTEST. USE OF THE COMMISSION OR ARTIST NAME IN ANY WAY THAT DISCREDITS REPUTATION OR VIOLATES SPIRIT OF COMMISSION. 
If you don't communicate for longer than a month, the agreement is no longer valid. 
I can deny or terminate a commission on the following grounds: 
you dont outline when I can eventually publicly display the image
breach of terms
a month or more of inadequate communication 
The request contains hateful, extremely mechanical, incestual, pedophilic, zoophilic, or racist imagery
I will make everything to be best of my ability
The commission will be completed accorsding to a timeline or deadline the commissioner specifies. If none is specified then a timeline detailed in complete contract will go into effect. 
I am allowed to use the commission in their portfolio or as a commission example in public.
I will do everything in my power to fulfill your requests, to a limit. I must also look after myself and my well beings. So alterations and revisions will be limited to reflect the artist's ultimate vision/mission. 
I , as the artist, reserve all legal/redistribution rights to the commission unless specified in a commercial purpose agreement. 
Ultimately this means that the customer has permission to share the work publicly and use it on display for private use but any reproduction of the work, especially reproductions that will be used for profit or commercial uses, is strictly prohibited unless approved by the artist in Commercial Purpose Commission Agreement. It cannot be turned into a NFT, printed for profit, used fro promotional purposes, or used to generate sales for the client in anyway unless specified within an agreed upon commercial purpose agreement. 
Until the commission is payed for in full, the commission images for review will be watermarked. 
Commissions will be delivered digitally via email or a download location. 
Artist isn't responsible for printing or shipping costs
Late delivery: client will be reimbursed a small percentage of the price if the commission isn't delivered in a timely manner with no communication as to why. Or in full if the commission isn't completed within 2 weeks of the deadline with no communication 
Payment: 50% is required up front before teh work can be started. And the other 50% is to be payed before the final commission is delivered. 
All prices are listed in USD
Fees possible: a rush fee if commission is time sensitive( to be done in less than two weeks),  revision fee ( for each minor revision after the 4th, or major revisions late in the process.) 
Termination/kill fee: can be sent by client at any time. Done in method of a written notice. Refunds only provided if artist is notified before starting the work. 
If commission is partially completed then client doesn not get refunded, artist retains lo rigths to works done so far. 
If the commission is already done at time of termination, then the client must pay the artist in full for their labor. 
Late payments are subject to an interest rate

Some examples of commercial use of a commission are: printing merchandise, promoting your store or social media, and any related money generating activity the client participates in using the work.
